Jury rules $8 million verdict in case against asbestos and tobacco companies Crane, Lorillard and H&V

Congratulations to Richard DeLisle, and his attorney, David Jagolinzer, who defeated both big asbestos, Crane Co., and big tobacco, Lorillard and H&V, after a 4-week trial culminating in nearly 5 days of jury deliberations. Jagolinzer tried the case against Jim Lowery for Crane, Ricardo Cedillo for Lorillard, and Carl Rowley for H&V.

Under recently adopted Florida rules, Defendants unsuccessfully challenged each of Plaintiff’s experts pursuant to Daubert. Lorillard and H&V also attempted to argue that despite Plaintiff’s consistent testimony throughout the pendency of the litigation, he never actually used their product!

After deliberating for nearly 5 days, the jury came back with a verdict in favor of Plaintiff for $8 million. Crane was hit with 16% of the liability. Lorillard and H&V each were apportioned 22% of the liability, with the remainder split between two Fabre defendants.
