The Wall Street Journal (12/3, Kendall, Subscription Publication, 2.29M) reports that the US Supreme Court recently announced that it had agreed to hear an appeal by drug company Takeda Pharmaceutical Co. in a case concerning a $21 million judgment won by a woman in New Hampshire who claimed that she had suffered severe, permanent injuries as a result of taking a generic drug to treat shoulder pain. The drug was manufactured by Takeda’s Mutual Pharmaceutical Co. Unit. The Journal notes that the case could potentially places further limits on consumers’ ability to bring product-liability lawsuits claiming harm by generic drugs.
