FDA warns Avon about misleading anti-wrinkle product marketing

The Wall Street Journal (10/17, B2, Dooren, Subscription Publication, 2.08M) reports that the US Food and Drug Administration has issued a warning to Avon Products Inc. about the marketing of some anti-wrinkle products. According to the Journal, the FDA has said that it has reviewed Avon’s website to examine claims associated with some of the company’s anti-wrinkle products, and the agency says that the claims suggest that the products are designed to affect the structure or any function of the human body, which would classify them as drugs under Federal law. The article goes on to describe other concerns the FDA expressed regarding Avon claims about some of its anti-wrinkle products, and it adds that the FDA has told Avon that it must fix any violations of Federal law found in its claims.

Reuters (10/17, Krishnamurthy) adds that the FDA said the wording in the promotional materials and product labeling suggested the anti-wrinkle line could affect the structure of human tissue, which would render the products drugs, making them subject to the new-drug approval process. The agency gave Avon 15 days to define how it plans to correct the marketing violations.
