A Philadelphia jury today returned a $1.4 million verdict and assigned 100% liability against sole remaining defendant, Owens Illinois. The Plaintiff’s decedent died from mesothelioma at the age of 84. All of the damages were for pain and suffering and loss of consortium.
Owens Illinois defended that they were not negligent and that the plainitff was not exposed to the Kaylo pipe insulation sold by Owns Illinois. Furthermore, Owens Illinois argued their product conformed to the state of the art with regards to asbestos thermal insulation. The jury rejected all of Owens Illinois’ defenses.
